The incident happened when nearly 200 pounds of vertically stacked MDF boards fell onto the plaintiff due to Home Depot’s failure to secure the display with required safety cables. Despite knowing that unsecured cables create a predictable fall hazard, the store had no written policy for checking or reattaching them. When the plaintiff attempted to measure a board, the stack collapsed, striking him and causing both a mild traumatic brain injury and a severe knee injury.
Home Depot admitted full liability on the eve of trial, leaving causation and damages for the jury. At trial, GBW’s trial team presented evidence showing significant cognitive, emotional, and functional changes following the incident, including declines in processing speed, emotional regulation, and work capacity. Despite returning to his demanding job, the plaintiff struggled with fatigue, memory issues, and personality changes that impacted both his career and personal relationships.
